Terms of service
These are the terms for using the websites of Magnolia Art Xchange (MAX), a 501(c)(3) nonprofit in Ocala, Florida: maxocala.org, donor.maxocala.org and the artist portal. By using them you agree to these terms. If you do not, please do not use the sites; you are always welcome to call or visit instead.

Buying
Buying art
Artwork on this site is original work by MAX’s artists, offered for sale by Magnolia Art Xchange on the artist’s behalf. Each piece is one of a kind: it can be sold once, and it is sold to the first person whose payment goes through. We do our best to describe and photograph work accurately, but colours vary between screens and handmade work varies by nature.
Prices are in US dollars. Payment is by card through Stripe. All sales are final. How you collect your piece, when a piece on show or on loan becomes available, and the few cases in which we refund, are set out in our sales policy, which is part of these terms.
Buying a piece gives you the object, not the copyright. The artist keeps the right to reproduce the image unless they agree otherwise with you in writing.
Giving
Donations, memberships and fees
Gifts to MAX are made to a 501(c)(3) organisation and are tax-deductible to the extent the law allows; we will send you a receipt. Gifts, Conductor’s Club memberships and application fees are not refundable, but if you gave by mistake or were charged the wrong amount, tell us promptly and we will put it right.
Tickets and entries for a particular event or game carry any extra terms shown where you buy them.
Booking and applying
Visits, rentals and applications
A visit or pickup booked online holds a time for you; if you cannot come, please change it or tell us. A venue-rental inquiry is a request, not a booking, until MAX confirms it in writing.
Booking the venue at maxocala.org/rent is different: it is the Facility Rental Agreement, signed by you and held on MAX's calendar, and the agreement shown to you at the time is the one that governs it. The $75 deposit is non-refundable, as that agreement says, and the balance of the rental fee is due to MAX at the end of the rental period. MAX countersigns each agreement and will contact you before the day.
When you apply for a residency or for the board, you confirm that what you tell us is true and that the work you show us is your own. Sending an application does not create any obligation on MAX to accept it.
Artists
The artist portal
The portal is for MAX’s artists, board, staff and partners, by invitation. Keep your password to yourself, and tell us if you think someone else has used your account. You are responsible for what you post.
You keep the copyright in your artwork and its photographs. By publishing a piece in the portal you allow MAX to show it, with your name, on its websites, in its building, in print and on social media, to promote you, the work and MAX, and to offer it for sale at the price you set, until you unpublish it. Terms about commission, payouts, shows and loans are those you have agreed with MAX and those shown in the portal.
Do not upload work that is not yours, anything unlawful, or anything that infringes somebody else’s rights. We may remove content or close an account that breaks these terms or puts others at risk.
The sites
What is ours, and fair use of it
The MAX name and logo, the design of these sites and the text on them belong to Magnolia Art Xchange. Images of artwork belong to the artists. You may share links and look as long as you like; please do not copy, scrape or reuse images or text for commercial purposes without permission.
Please do not try to break, overload or gain unauthorised access to the sites, use them to send spam, or interfere with anybody else’s use of them.
We link to other websites, such as our payment companies and social media. We are not responsible for what is on them.
The small print
Disclaimers and the law
We work to keep these sites accurate and available, but they are provided as they are, without warranties of any kind, and event details, prices and availability can change. To the fullest extent the law allows, Magnolia Art Xchange is not liable for indirect or consequential losses arising from your use of the sites, and our total liability for any purchase is limited to the amount you paid for it. Nothing here limits rights you have by law that cannot be limited.
These terms are governed by the laws of the State of Florida, and any dispute belongs in the courts of Marion County, Florida. If part of these terms cannot be enforced, the rest still applies. We may update them; the version posted here, with its date, is the one in force.
